1. TERMS AND CONDITIONS APPLICABILITY

• This Terms and Conditions document regulates the purchases via the Time for Sicily Online Shop
• If the customer accesses or uses the Online Shop, the Terms and Conditions are agreed and will be binding
• A purchase is concluded only when the Terms and Conditions are accepted on the Online Shop. When a purchase is concluded, the Terms and Conditions are accepted by the customer and will be binding
• If the customer does not agree with the Terms and Conditions, he/she should refrain from using the Online Shop
• Time for Sicily may change the Terms and Conditions from time to time (and may or may not let the customer know). Therefore the customer should come back to this page regularly to check the Terms and Conditions
• The customer can see the date Time for Sicily last changed the Terms and Conditions noted above.  If the customer continues to use the Online Shop after Time for Sicily changed the Terms and Conditions, then the new Terms and Conditions are agreed

 

2. USE OF THE ONLINE SHOP

• The customer must be at least 18 years old to use the Online Shop
• The Online Shop is functioning 24 hours a day, 365 days a year. However, Time for Sicily cannot guarantee that access will not be interrupted or error free. Access might be unavailable temporarily without notice in case of a system failure, maintenance or any reason beyond the control of Time for Sicily
• During the order process, the customer may choose a username and password, or log in via the provided Social Media options. The customer is responsible for his/her account and all actions taken under that username and password. The customer must only purchase from the Online Shop under his/her own username and password. The customer must make every effort to keep his/her password safe and should not disclose it to anyone. If the customer thinks someone else might know it, he/she must change it immediately. The customer may not transfer or sell his/her username to anyone, nor permit, either directly or indirectly, anyone to use his/her username or password. If there are any changes to the details supplied by the customer it is his/her responsibility to contact Time for Sicily as soon as possible
• Time for Sicily has the right to end the agreement with the customer for his/her use of the Online Shop if he/she breaches these Terms and Conditions or if Time for Sicily suspects he/she has breached these terms or is engaged, or is about to be engaged or has been involved in fraudulent or illegal activity in connection with the Online Shop or on the site

 

3. ORDERING PROCESS

• When placing an order, the customer agrees that any and all the information provided is accurate and complete
• Prices listed on the Online Shop are correct at the time of entering the information. However, Time for Sicily reserves the right to change prices of any product at any time. The total price of the order, including VAT (0%), will be displayed prior to the purchase confirmation
• No contract for the sale of any product will exist between Time for Sicily and the customer until the order is accepted by Time for Sicily by emailing the confirmation invoice to the email address given during the ordering process
• The customer must check that all details on the confirmation invoice are correct and contact Time for Sicily as soon as possible if any details are incorrect
• Discount vouchers, codes and offers cannot be used on sale/ already discounted products unless otherwise stated

 

4. PAYMENT METHOD

• The Online Shop uses “PayPal” and “Stripe” as payment processors for online transactions. The customer can purchase via PayPal or the credit cards accepted by the Stripe payment processor. For more information on PayPal and Stripe, the customer should consult the: PayPal Terms & Conditions or Stripe Global Privacy Policy
• All purchases will be charged to the customer’s nominated card or account upon submission of the order. All credit and debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of the customer’s payment card refuses to authorize the payment, Time for Sicily will not be liable for any delay on non-delivery
• Time for Sicily is not liable for any additional charges imposed by the customer’s card issuer

 

5. DELIVERY OF THE EBOOK TRAVEL GUIDE

• The eBook travel guide is delivered after the purchase in pdf format only, downloadable from the customer’s “Account” section of the Online Shop
• The customer receives in addition an email containing the order summary and a link to access the “Account” section of the Online Shop in order to download the eBook
• It is the customer’s responsibility to ensure that an accurate and valid email address is provided during the ordering process

 

6. TRAVEL GUIDES CONTENT

• The travel plans provided must be considered as non-binding proposals with the ultimate and only end of providing inspiring travel ideas
• The travel guide available for purchase is delivered in an English version only and in pdf format only
• The purchase of the travel guide refers to that edition only and does not entitle for digital copies of subsequent editions when they are released. A more recent edition need to be bought separately
• The travel guide content changes from edition to edition, therefore please consult the preview of the product on www.timeforsicily.com to make the right choice
• Time for Sicily does not carry any responsibility and/or liability directly or indirectly deriving or caused from/by the traveler’s purchases with the recommended providers
• Time for Sicily does not carry any responsibility and/or liability for the changes in the offering (including price) of the recommended providers
• When the customer buys a service from a third-party provider suggested in the travel guide, he/she accepts the third-party Terms and Conditions
• The service offered does not constitute a concierge offering with round-the-clock assistance
• Time for Sicily neither owns nor claims any rights on the media collected in the eBook travel guide. Content constitutes a mere aggregation from publicly available sources¹

 

7. SHARING OF THE EBOOK TRAVEL GUIDE

• The customer can only use the eBook travel guide for personal, non-commercial purposes
• The customer may not share any eBook travel guide by forwarding or sending it to someone else
• The customer agrees that he/she could only download and use the content for his/her individual and non-commercial use. Furthermore, the customer is not permitted to broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of the Time for Sicily web pages and eBooks for any other purpose whatsoever without the prior written permission of Time for Sicily.

 

8. CUSTOMER’S RIGHTS

• Right of cancellation: no cancellation, return, refund is allowed for digitally delivered product such as the Time for Sicily eBook travel guides. Once the transaction has taken place and the pdf has been delivered to the provided customer’s email address, the claims above cannot be satisfied
• Transparent information on T&Cs: the customer will receive a link to the Travel guide Terms and Conditions related to the purchase via email, together with the order summary

 

9. TAXES

• Time for Sicily KLG is a company incorporated in Zürich, Switzerland. In compliance with the relevant Swiss Tax rules, Time for Sicily KLG is exempted from levying VAT on any sales on its Online Shop
• The total price of the order will display “including VAT (0%)”

 

10. PRIVACY & COOKIE POLICY

• The customer’s personal information received is processed according to the Time for Sicily Privacy Policy.  This Terms and Conditions document must be read together with the Privacy Policy and the Cookie Policy available on www.timeforsicily.com
• In the use of PayPal services integrated in the Online Shop, the PayPal Privacy Policy applies
• In the use of Stripe services integrated in the Online Shop, the Stripe Privacy Policy applies

 

11. DISCLAIMER AND LIMITATION OF LIABILITY

Time for Sicily uses reasonable care and skill to ensure the accuracy of the information provided through the Online Shop and in all services purchased through the Online Shop. However, Time for Sicily does not accept liability (except as set out below) for any errors/ omissions in the Online Shop and reserve the right to change information, prices, specifications and descriptions of listed products and services at any time and without notice.

EXCEPT AS PROVIDED BY LAW, TIME FOR SICILY CANNOT GUARANTEE THAT THE ONLINE SHOP OR PRODUCTS PURCHASED THROUGH THE ONLINE SHOP WILL BE 100% ACCURATE OR UP TO DATE.  THE INFORMATION IN THE ONLINE SHOP OR PRODUCTS PURCHASED THROUGH THE ONLINE SHOP IS GENERAL AND MAY NOT BE SUITABLE FOR THE CUSTOMER’S PARTICULAR NEEDS.  THE CUSTOMER SHOULD VERIFY CRITICAL INFORMATION (SUCH AS ADVICE ABOUT VISAS, HEALTH AND SAFETY) INDEPENDENTLY BEFORE THE TRAVEL/ACTIVITY/EXPERIENCE.  THE CUSTOMER ACKNOWLEDGES THAT HE/SHE USES THE ONLINE SHOP AND ALL PRODUCTS PURCHASED THROUGH THE ONLINE SHOP AT HIS/HER OWN RISK. EXCEPT AS PROVIDED BY LAW, THE ONLINE SHOP AND ALL PRODUCTS PURCHASED THROUGH THE ONLINE SHOP ARE PROVIDED ‘AS IS’ AND “AS AVAILABLE” AND WITHOUT ANY WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED.  TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIME FOR SICILY EXCLUDES ALL IMPLIED REPRESENTATIONS AND WARRANTIES (INCLUDING, FOR THE AVOIDANCE OF DOUBT, THOSE IN RELATION TO MARCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) WHICH, BUT FOR THE TERMS AND CONDITIONS, MIGHT APPLY IN RELATION TO THE USE OF THE ONLINE SHOP OR OF PRODUCTS PURCHASED THROUGH THE ONLINE SHOP.

TIME FOR SICILY IS NOT RESPONSIBLE FOR:

• LOSS THAT WAS NOT REASONABLY FORESEEABLE;
• LOSS THAT WAS NOT CAUSED BY BREACH OF CONTRACT OR BY NEGLIGENCE;
• INDIRECT OR SECONDARY LOSS THAT ARISES FROM ANY BREACH;
• LOSSES THAT RELATE TO A BUSINESS, SUCH AS LOST DATA, LOST PROFITS OR BUSINESS INTERRUPTION, THAT THE CUSTOMER OR A THIRD PERSON IS ENGAGED IN;
• LOSSES CAUSED BY ANY INNACURACY IN THE INFORMATION THE CUSTOMER PROVIDES TO TIME FOR SICILY, SUCH AS DELIVERY OR PAYMENT INFORMATION; OR
• ANY INCREASE IN LOSS THAT WAS CAUSED BY THE CUSTOMER’S BREACH OF CONTRACT OR NEGLIGENCE.

THE CUSTOMER MUST TAKE ALL REASONABLE STEPS TO MINIMIZE THE EXTENT OF ANY LOSS MAY SUFFER AS A RESULT OF THE USE OF THE ONLINE SHOP OR ANY PRODUCTS PURCHASED THROUGH THE ONLINE SHOP.

TIME FOR SICILY SHALL HAVE NO LIABILITY FOR ANY DAMAGE OR DELAY IN THE USE OR DELIVERY OF PRODUCTS ORDERED OR ANY OTHER MATTERS TO THE EXTENT THAT THE DELAY OR DAMAGE IS DUE TO ANY EVENT OUTSIDE REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, WAR, FLOOD, EARTHQUAKE, ERUPTION, FIRE, LABOUR DISPUTES, STRIKES, THEFTS, LOCK-OUTS, RIOTS, CIVIL COMMOTION, MALICIOUS DAMAGE, EXPLOSION, GOVERNMENTAL ACTIONS AND ANY OTHER SIMILAR EVENTS.

TIME FOR SICILY MAXIMUM LIABILITY TO THE CUSTOMER IN RELATION TO THE USE OF THE ONLINE SHOP IS THE AMOUNT PAID BY THE CUSTOMER FOR THE ITEM THAT IS THE SUBJECT OF THE CLAIM.

 

12. COMPLAINTS, DISPUTES, GOVERNING LAW AND JURISDICTION

• In case of complaints or disputes, the customer should contact Time for Sicily which will try to sort it out
• The Law of Switzerland applies to all disputes and the competent court is set in Zürich
